Dependency, Neglect, and Abuse Cases
DNA CASES (DEPENDENCY, NEGLECT AND ABUSE)
In Kentucky, cases involving child abuse and neglect are referred to as “DNA” (Dependency, Neglect, and Abuse) actions and are governed by the Kentucky Unified Juvenile Code. These actions are brought in family circuit court, if one presides, and if not district court. Since our judicial circuit including Rowan County does not have family court, the county attorney’s office brings these matters to the Rowan District Court.
DNA cases are not criminal, and parties are not imposed jail time. However, separate criminal cases arise when neglect or abuse to a child classifies as a criminal violation and punishable under the law. Through DNA actions, our office efforts focus to protect children from neglect and abuse and ensure that every child is provided a safe and nurturing home. We remove children from homes only when absolutely necessary and when there is abuse and neglect, or a risk of abuse and neglect.
We do this in cooperation with Rowan County DCBS who investigates cases of child abuse and neglect, as well as works with families to strengthen family life for protection and care of children. Under the law, any person in Kentucky who knows or suspects that a child is being abuse or neglected is mandated to report.
